1. Legal Framework in India (Constitutional Protection)
SandPra.Tournament operates strictly within the legal framework established by the Constitution of India and the statutory provisions of Indian law governing online competitions and eSports.
Constitutional Right: The right to organize, participate in, and operate skill-based games and competitive eSports contests is protected under Article 19(1)(g) of the Constitution of India as a recognized commercial, occupational, and business freedom.
Section 12 of the Public Gambling Act, 1867, and corresponding state gambling statutes explicitly state that anti-gambling provisions do not apply to any "game of mere skill wherever played."
2. Supreme Court Jurisprudence on "Game of Skill"
The Hon'ble Supreme Court of India has established authoritative legal precedents distinguishing Games of Skill from gambling, wagering, and betting:
- State of Bombay v. R.M.D. Chamarbaugwala (AIR 1957 SC 699): The Supreme Court held that competitions where success depends on a substantial degree of skill are commercial activities protected by Article 19(1)(g) and are not gambling or lotteries.
- State of Andhra Pradesh v. K. Satyanarayana (AIR 1968 SC 825): The Supreme Court ruled that a game of skill is one where, although the element of chance necessarily cannot be entirely eliminated, success depends predominantly upon superior knowledge, training, attention, experience, and adroitness of the player.
- Dr. K.R. Lakshmanan v. State of Tamil Nadu (AIR 1996 SC 1153): The three-judge bench affirmed that games where success predominantly depends on player skill, judgment, and physical/mental capabilities are legally protected "Games of Skill."
3. Why eSports (BGMI, Free Fire, Valorant) are Pure Games of Skill
Competitive eSports titles hosted on SandPra.Tournament—including Battlegrounds Mobile India (BGMI), Free Fire, and Valorant—require extensive professional skill, daily practice, and tactical mastery:
- Motor Skills & Reflexes: Sub-second reaction times, pinpoint crosshair placement, precise target tracking, and mechanical control of recoil patterns.
- Tactical Strategy & Map Awareness: Dynamic zone rotations, spatial terrain awareness, cover utilization, vehicle maneuvering, and inventory resource management.
- Teamwork & Communication: Real-time squad coordination, role allocation (IGL, fragger, support, sniper), utility usage (smokes, grenades), and clutch situational decision-making.
- Absence of Chance: Match outcomes are determined 100% by player actions in the custom match room and not by random chance, lotteries, or betting odds.
4. Zero Entry Fee Policy & Platform Facilitator Model (No Wagering / No Betting)
SandPra.Tournament is a Technology & Match-Management SaaS Platform. All competitive skill contests on our platform adhere to a strict Zero Entry Fee Policy (₹0 Entry Fee). We do not collect betting stakes, gambling funds, or pool player contributions:
- ₹0 Entry Fee: Participation in tournaments does not involve any entry stakes or gambling buy-ins. Contests are purely skill-based tests of gamer ability.
- Nominal Platform Convenience Fee: Where applicable on select managed matches, a nominal platform fee is charged exclusively for custom match room server hosting, anti-cheat detection, referee supervision, and live leaderboard management software.
- No House / No Wagering: The platform does not act as a bookmaker or casino. We do not set betting odds, take bets against the house, or conduct any games of chance.
- Pure Skill Competition: All registered participants compete directly against one another under identical match conditions, with skill-based performance rewards distributed strictly according to official in-game rankings and eliminations.
5. Restricted States Compliance
